Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and RemoteAI ("Company," "we," "us," or "our") governing your access to and use of the RemoteAI platform, website at remoteai.io, and all related services (collectively, the "Service").

By registering an account, posting a job, creating a talent profile, or otherwise using the Service, you confirm that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You have read, understood, and agree to be bound by these Terms and our Privacy Policy

RemoteAI is a specialized hiring marketplace connecting companies seeking AI talent with professionals specializing in artificial intelligence, machine learning, data science, LLM engineering, AI automation, and related fields.

Our platform provides, among other things:

RemoteAI acts as a platform facilitator only. We are not a recruitment agency, employer, or party to any employment or contract agreement entered into between companies and talent through our platform.

To access most features of RemoteAI, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration and keep it up to date.
• Keep your login credentials confidential. You are responsible for all activity that occurs under your account.
• Notify us immediately via our Help Center if you suspect unauthorized access to your account.
• Not create more than one personal account or create an account on behalf of another person without their consent.
• Not use a false identity, impersonate any person, or misrepresent your affiliation with any company.

We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or engage in fraudulent or abusive behavior.

When using RemoteAI as a company or hiring manager, you agree to the following:

You may not use RemoteAI to:

• Post fake, fraudulent, or misleading job listings or profiles
• Collect, scrape, or harvest user data without explicit permission
• Use our platform to send unsolicited commercial messages (spam)
• Attempt to reverse-engineer, decompile, or access non-public parts of our systems
• Upload malware, viruses, or any malicious code
• Interfere with or disrupt the integrity or performance of the platform
• Attempt to gain unauthorized access to another user's account
• Violate any applicable local, national, or international law or regulation
• Engage in any discriminatory, harassing, or abusive behavior toward other users
• Create multiple accounts to abuse free trial periods or platform limits

You retain ownership of any content you submit to RemoteAI (profile descriptions, job postings, messages). By submitting content, you grant RemoteAI a non-exclusive, worldwide, royalty-free license to use, display, and reproduce your content solely to operate and improve the platform.

You are solely responsible for the content you submit. You represent and warrant that:

• You own or have the right to use the content you submit
• Your content does not infringe any third-party intellectual property rights
• Your content does not contain defamatory, obscene, or unlawful material

We reserve the right to remove any content that violates these Terms or that we deem, in our sole discretion, to be harmful or inappropriate.

The RemoteAI platform, including its design, code, features, logo, branding, and all original content created by RemoteAI, is owned by RemoteAI and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our platform or its underlying technology, nor may you reverse engineer or attempt to extract the source code of our software.

The RemoteAI name, logo, and all related marks are trademarks of RemoteAI. You may not use them without our prior written consent.

Certain features of RemoteAI are available on a paid subscription basis for companies. By subscribing to a paid plan:

• You authorize RemoteAI to charge your payment method on the applicable billing cycle (monthly or annually).
• Subscription fees are non-refundable unless otherwise specified or required by law. If you cancel, you retain access until the end of the current billing period.
• Prices may change with 30 days notice. Continued use after a price change constitutes acceptance of the new pricing.
• All payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service.
• If a payment fails, we will attempt to retry and may suspend access to premium features until payment is resolved.
• Job posting credits are non-refundable and expire after 12 months from the date of purchase.

Talent profiles are and will always be free to create on RemoteAI.

RemoteAI provides the platform "as is" and "as available" without any warranties, express or implied, including but not limited to:

• Merchantability, fitness for a particular purpose, or non-infringement
• Continuous, uninterrupted, or error-free operation
• The accuracy or completeness of any user-submitted content (including job postings and talent profiles)
• Successful matching of talent to jobs or successful hiring outcomes

RemoteAI is not responsible for the conduct of users on the platform, or for any employment or contractual relationship that arises from use of the platform.

To the maximum extent permitted by applicable law, RemoteAI and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, business opportunities, or goodwill
• Damages resulting from unauthorized access to or alteration of your data

In no event shall our total aggregate liability to you exceed the greater of (a) the amount you paid to RemoteAI in the 12 months preceding the claim, or (b) €100. Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless RemoteAI and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to:

• Your use of RemoteAI or violation of these Terms
• Content you submit to the platform
• Any employment or contract disputes between companies and talent
• Violation of any third-party rights including intellectual property rights

By you: You may close your account at any time from your account settings. Upon closure, your public profile will be removed. We will retain certain data as required by law or our retention policies (see our Privacy Policy).

By RemoteAI: We reserve the right to suspend or terminate your account, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or if required by law. In cases of serious violations, termination is immediate.

Upon termination, your right to use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which RemoteAI is registered, without regard to conflict of law provisions.

Before initiating any formal legal proceedings, we encourage you to contact us via our Help Center to seek an informal resolution. We will attempt to resolve disputes amicably within 30 days.

If an informal resolution is not possible, disputes shall be resolved through binding arbitration or the courts of the applicable jurisdiction. Both parties waive the right to a jury trial and agree to individual (non-class action) proceedings.

We may revise these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Send an email notification to all registered users
• Display a prominent banner on the platform for at least 30 days

Your continued use of RemoteAI after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the platform and close your account.
